Utah requires grant applicants to demonstrate pre-existing agreements with landowners controlling access routes to the Mountain Meadows site before any interpretive materials are developed. Current access depends on three private parcels whose owners have declined repeated Utah State Historic Preservation Office requests for formal right-of-way documentation. Without recorded easements, any education program risks suspension during seasonal livestock movements.
The state readiness metric is therefore the percentage of required easements recorded in Iron County recorder files before the first public program date. Proposals must attach preliminary title reports dated within 90 days of submission.
These requirements exist because the site sits on land administered under Utah's unique school-trust-land statutes, which mandate revenue generation even for low-impact educational use. Neighboring Nevada and Arizona programs operate under different federal land-management overlays that do not impose the same revenue test.
Implementation sequencing therefore begins with legal review of trust-land lease options rather than curriculum development. Applicants must provide a timeline showing easement recording at least 120 days before any scheduled public session.
Utah applications receive scoring credit only when they include letters from the School and Institutional Trust Lands Administration confirming that proposed lease terms align with current fiduciary obligations. All interpretive content must also reference the 2018 Utah State Legislature resolution directing balanced presentation of the 1857 events.
